GENERAL TERMS AND CONDITIONS OF USE OF THE WEBSITE WWW.ROVINIETE.RO
 

1. GENERAL PROVISIONS

Please read carefully the terms and conditions for using this website, set out below. Accessing and using the website www.roviniete.ro implies the express, full and unconditional acceptance of these General Terms and Conditions, which constitute the entire legal agreement between the parties.

All orders placed through www.roviniete.ro are subject to the lawfully concluded distribution contract for roviniete/tolls (PEAJ) held by SCALA ASSISTANCE S.R.L., as an authorized distributor. Placing any type of order implies the User’s express agreement with the terms of the distribution contract.

SCALA ASSISTANCE S.R.L. is also an economic operator authorized by the Hungarian authority National Mobile Payment Plc. (Nemzeti Mobilfizetési Zrt.) for the distribution of huvinietes.

SCALA ASSISTANCE S.R.L. is an authorized distributor of roviniete and is subject to the special legislation in force (Government Ordinance no. 15/2002 and Order of the Minister of Transport no. 1463/2018). SCALA ASSISTANCE S.R.L. is also an authorized distributor of Huvinietes for Hungary, in accordance with Hungarian Law CXLV/2020 on the electronic distribution of vignettes. The activity is carried out in accordance with the authorizations and distribution agreements in force at the date of this version.

This document has been drawn up in accordance with the provisions of Law no. 365/2002 on electronic commerce, republished, as subsequently amended and supplemented, Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, as well as amending and supplementing certain legislative acts, Law no. 214/2024 on the use of the electronic signature, time stamp and the provision of trust services based thereon, as well as Regulation (EU) 2016/679 (GDPR).
 

2. DEFINITIONS

Site – the online platform www.roviniete.ro, operated by SCALA ASSISTANCE S.R.L., through which Users can purchase roviniete, huviniete and other related products or services.

User – any natural or legal person accessing the website.

Client – the User who places a valid order.

Provider – SCALA ASSISTANCE S.R.L., the entity that manages the www.roviniete.ro platform and ensures the distribution of the available products.

Order – the electronic request placed through the website, which constitutes the agreement of will between the Client and the Provider.

Rovinietă – the electronic record in the database of the National Company for Road Infrastructure Administration (CNAIR) certifying the payment of the usage fee for the national road network in Romania.

Huvinietă – the electronic record issued by the authorities in Hungary certifying the payment of the usage fee for the national road network in Hungary.

Contract – the legal agreement between the Provider and the Client, governed by this document.
 

3. GENERAL TERMS OF USE

By accessing the website www.roviniete.ro, the User confirms that they have read, understood and accepted this set of General Terms and Conditions. The User has the obligation to periodically check the content of these General Terms and Conditions, as continued access and use of the website implies acceptance of any changes made.

SCALA ASSISTANCE S.R.L. reserves the right to modify at any time the content, structure and functionality of the website, without prior notice.

Access to and use of the website are allowed exclusively for personal, non-commercial purposes. It is forbidden to copy, modify, resell or exploit any part of the content for commercial purposes without the prior written consent of SCALA ASSISTANCE S.R.L. Any use of the website for unlawful, abusive or otherwise detrimental purposes to the legitimate interests of the Provider is strictly prohibited.

Unauthorized use of the website (unauthorized access, copying, blocking, alteration of data) constitutes an offence and is punishable under criminal law.

Continued use of the website www.roviniete.ro after the publication of any changes constitutes the User’s express, full and irrevocable acceptance of the new General Terms and Conditions.
 

4. SERVICES PROVIDED

4.1. General description of services

The website www.roviniete.ro offers the following services:

  • purchase of roviniete for the national road network in Romania;
  • purchase of huviniete for Hungary;
  • issuance of invoices in electronic format;
  • delivery of all products by e-mail;
  • paid SMS alert service regarding the expiry of the rovinieta.

The rovinieta fee includes VAT and the costs of delivery by e-mail. No additional fees are charged on top of the rovinieta. Orders may also be placed by Users from other EU Member States, in compliance with the applicable technical and fiscal conditions.

4.2. SMS alert service

This service is intended to warn the User of the expiry of a purchased rovinieta.

The information transmitted by SMS is based on the data entered by the User when placing the order. The Provider is not liable for any errors resulting from incorrect entry of the telephone number or from malfunctions of the mobile phone network.

SCALA ASSISTANCE S.R.L. may temporarily or permanently suspend the SMS alert service, without prior notice, in the event of technical malfunctions, suspension of cooperation with mobile operators or in cases of force majeure.

The Provider does not guarantee real-time receipt of the SMS alert. The transmission of the alert depends exclusively on the mobile operator’s network and on the accuracy of the data entered by the User.
 

5. ORDERS AND PAYMENTS

By placing an order, the User guarantees that they have provided real, complete and accurate information. Responsibility for the correctness of all data entered, such as the vehicle category, registration number and chassis series, lies exclusively with the Client. SCALA ASSISTANCE has no right and does not assume any responsibility to modify or correct the data entered by the Client, full responsibility resting solely with the Client.

The Client bears full responsibility for the accuracy of the information provided, including with regard to the vehicle category, type of fuel, registration number and selected validity period.

Orders may be paid only by the payment methods indicated on the website, namely by bank card, bank transfer or other electronic instruments authorized by the Provider.

The products are issued only after the payment has been confirmed by the payment processor. If payment is not confirmed within 24 hours, the order will be automatically cancelled, without any further obligations for the Provider.

In the case of payments made by bank transfer, roviniete/huviniete are issued only after the funds have been credited to the account of SCALA ASSISTANCE S.R.L. Issuance is carried out during the working hours displayed on the website (Monday–Friday, between 08:00–17:00, except for non-working days).

By placing the order, the Client expresses their agreement for the invoice to be issued in electronic format.

The invoice is automatically issued based on the data entered by the Client, and Scala Assistance is not liable for errors resulting from incorrectly provided information.

Roviniete cannot be backdated. The start date of validity cannot precede the date of confirmation of the transaction.

The electronic invoice issued by SCALA ASSISTANCE S.R.L. is electronically signed in accordance with the provisions of Law no. 214/2024 and has the same legal value as a printed invoice.

Returns

Roviniete, as customized digital services, cannot be returned, and the Client is not entitled to the right of withdrawal provided by Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, as well as amending and supplementing certain legislative acts, as subsequently amended and supplemented.
 

6. ISSUANCE AND DELIVERY OF VIGNETTES

Vignettes are issued automatically, immediately after confirmation of payment and validation of the complete correctness of the data entered by the Client into the system. The vignettes are sent in electronic format to the e-mail address indicated by the Client or downloaded directly into the application used.

If the User does not receive the confirmation e-mail containing the ordered vignettes, or is unable to download them, they are obliged to inform SCALA ASSISTANCE S.R.L. by e-mail at comenzi@roviniete.ro or by phone at +40 213 009 696.

Complaints regarding non-receipt of documents must be submitted within a maximum of 24 hours from the time of payment, in order to allow verification and re-issuance, if applicable.

The maximum time limit for reporting possible material errors in the rovinieta is 60 minutes from the receipt of the e-mail containing the invoice and the purchased rovinieta, in accordance with the provisions of Order of the Minister of Transport no. 1463/2018.

After the expiry of this time limit, SCALA ASSISTANCE S.R.L. cannot be held liable for any consequences of using national roads without a valid rovinieta, or without a valid Huvinietă in Hungary. Any request sent after this time limit will be treated as a request for assistance, without any obligation on the Provider to reissue or compensate.

Invoices are issued in accordance with the provisions of Law no. 214/2024 on the use of the electronic signature, time stamp and the provision of trust services based thereon.

The electronic invoice issued in accordance with Law no. 214/2024 constitutes the original tax document and has the same legal value as a printed invoice.
 

7. RIGHTS AND OBLIGATIONS OF THE PARTIES

SCALA ASSISTANCE S.R.L. is obliged to ensure the functioning of the website and the correct issuance of vignettes, under the conditions laid down by law. The Provider will make all reasonable efforts to maintain the continuous and secure operation of the www.roviniete.ro platform, but does not guarantee uninterrupted or error-free operation.

The Client is obliged to provide real, accurate, complete and up-to-date data concerning the vehicle for which the rovinieta is requested, including the vehicle category, registration number and chassis series.

SCALA ASSISTANCE S.R.L. does not have the technical possibility to verify or correct this data, and responsibility for the accuracy of the information entered lies exclusively with the Client. If the Client has entered any of this information incorrectly, they assume full legal and financial consequences, including any penalties imposed by the competent authorities for driving without a valid rovinieta. Any request to modify data after the vignettes have been issued is considered null, as the national issuing systems of the authorities do not allow subsequent correction of the recorded information.

Resale or redistribution of vignettes is strictly prohibited, in accordance with the applicable legislation and the provisions of the authorized distribution contracts.
 

8. LIMITATION OF LIABILITY

The Provider is not liable for errors caused by the User’s negligence, by the malfunction of the internet connection, third-party networks or the User’s equipment.

Receipt of payment confirmation from the processor does not guarantee the issuance of the rovinieta/huvinieta – it is valid only after receipt of the invoice and the ordered vignette from Scala Assistance.

The issuance of the rovinieta/huvinieta is considered finalized only upon receipt of the automatic confirmation message from the www.roviniete.ro system, which contains the valid electronic document accompanied by the invoice.

SCALA ASSISTANCE S.R.L. is not liable for any delays caused by third parties (payment processors, CNAIR/Nemzeti, mobile operators, etc.).

SCALA ASSISTANCE S.R.L. cannot be held liable for malfunctions occurring in the systems of CNAIR/Nemzeti, in the platforms of payment processors or in the infrastructure of electronic communications operators.

SCALA ASSISTANCE S.R.L. cannot be held liable for penalties imposed by the competent authorities in the event of using public roads without a valid rovinieta/huvinieta, regardless of the cause, including in situations arising from incorrect data entry by the Client.
 

9. FORCE MAJEURE

Neither party shall be liable for failure to perform its obligations if such failure is due to an event of force majeure, as defined by Romanian law and court practice.

The party invoking force majeure is obliged to notify the other party within a maximum of 5 working days from the occurrence of the event and to provide, within 15 days, proof issued by the Chamber of Commerce and Industry of Romania.

Cases of force majeure may include, but are not limited to: major technical failures of IT systems, cyber-attacks, natural disasters, fires, floods, general strikes, armed conflicts, unforeseen government measures or other events beyond the control of the parties.

The effects of the force majeure event suspend the performance of the parties’ obligations for the duration of the event, without triggering contractual liability.
 

10. INTELLECTUAL PROPERTY RIGHTS

The entire content of the website www.roviniete.ro (including, but not limited to, texts, images, graphic elements, logos, trademarks, distinctive signs, interfaces, source and object code, databases, the structure and design of pages) belongs to SCALA ASSISTANCE S.R.L. or is used under licenses and is protected by Law no. 84/1998 on trademarks and geographical indications, republished, as subsequently amended and supplemented.

It is prohibited to reproduce, distribute, publish, transmit, lease, lend, publicly communicate, modify, create derivative works from or otherwise use the content, in whole or in part, for commercial or non-commercial purposes, without the prior express written consent of SCALA ASSISTANCE S.R.L.

The User is granted a limited, non-exclusive, non-transferable and revocable license to access and use the website for personal, non-commercial purposes, in compliance with these Terms and Conditions.

It is strictly forbidden to use any automatic or manual means of data collection (web scraping, crawling, harvesting), decompilation, reverse engineering or any other activity intended to extract, access or reuse substantial parts of the website’s databases; the sui generis rights of the database producer are protected under Law no. 8/1996.

The trademarks, trade names and logos displayed on the website are registered or unregistered trademarks of SCALA ASSISTANCE S.R.L. or its partners; their use without the consent of the holder is prohibited.
 

11. NEWSLETTER

The Client may unsubscribe at any time by sending a request to office@roviniete.ro, by accessing the unsubscribe link included in each electronic communication or by fax at 004.0264.593.707.

SCALA ASSISTANCE S.R.L. does not send unsolicited commercial messages (“spam”) and complies with the principles of prior consent and personal data protection, according to applicable legislation.

By subscribing to the newsletter, the User expressly agrees to receive periodic information regarding services, products, promotions or updates of the www.roviniete.ro platform. Data collected for this purpose is processed exclusively for sending communications and will not be used for other purposes.

The Provider reserves the right to temporarily or permanently discontinue the newsletter service without prior notice, without this decision giving rise to any obligation towards subscribers. 
 

12. PERSONAL DATA PROTECTION (GDPR)

12.1. Purpose and legal basis of data processing

In accordance with Regulation (EU) 2016/679 (GDPR) and Law no. 190/2018, SCALA ASSISTANCE S.R.L. processes clients’ personal data exclusively for the purpose of providing the services available on the www.roviniete.ro platform, namely the issuance and management of roviniete, the issuance of tax documents, the transmission of payment confirmations and related communications.

The legal basis for processing is Article 6(1)(b) of Regulation (EU) 2016/679 – performance of a contract, as well as the legal obligations incumbent on the Provider under fiscal and road legislation.

Data processed includes: first and last name, e-mail address, telephone number, vehicle registration number, chassis series, billing data, personal identification number (CNP), ID series and number.

Purpose of processing: fulfillment of legal obligations regarding the issuance of the rovinieta and informing clients.

12.2. Storage period and data security

The data storage period is 5 years from the last transaction, in accordance with fiscal legislation.

Data is stored in electronic format on secure servers, protected by appropriate technical and organizational measures to prevent unauthorized access, loss, destruction or disclosure.

12.3. Data subjects’ rights

User rights include:

  • right of access to data;
  • right to rectification and erasure;
  • right to object and to restriction of processing;
  • right to lodge a complaint with ANSPDCP;
  • right to data portability;
  • right to withdraw consent where processing is based on consent;
  • right to request restriction of processing in certain situations provided by law.

The legal basis for data processing is the performance of the contract and the legal obligations of SCALA ASSISTANCE S.R.L.

12.4. Data transfer and disclosure

SCALA ASSISTANCE S.R.L. does not transfer or disclose personal data to third parties, except where required by law or necessary for the performance of the contract. No data transfers take place outside the European Economic Area. 
 

13. DISPUTES AND APPLICABLE LAW

The use of the website www.roviniete.ro, as well as the interpretation and application of these Terms and Conditions, are governed by Romanian law in force.

Any disagreement or complaint arising in connection with the use of the website will be resolved primarily amicably, by contacting the support team at comenzi@roviniete.ro.

If an amicable solution is not possible, disputes will be settled by the competent courts in Romania, at the registered office of SCALA ASSISTANCE S.R.L.

As a consumer, you have the right to use alternative dispute resolution (ADR) procedures provided by the National Authority for Consumer Protection (ANPC), by accessing the Integrated ADR Electronic Platform – https://reclamatiisal.anpc.ro/Depune-cerere-SAL
 

14. UPDATING THE TERMS AND CONDITIONS

SCALA ASSISTANCE S.R.L. reserves the right to modify or update at any time the content of these General Terms and Conditions in order to reflect legislative, technical or operational changes. The revised version will be published on the website and will apply from the date of publication. Users are encouraged to periodically review this section to stay informed of any changes.

Continued use of the website after publication of the changes constitutes express acceptance of the new Terms and Conditions.
 

15. INTERNAL CONCILIATION

If the User encounters problems related to orders placed or the functioning of the website, they may submit a complaint to comenzi@roviniete.ro for an amicable settlement. SCALA ASSISTANCE S.R.L. analyzes each request within a reasonable time and makes all efforts to resolve reported situations promptly and amicably.

For consumer protection complaints, Users may contact the National Authority for Consumer Protection (ANPC) – www.anpc.ro.
 

16. FINAL PROVISIONS

These General Terms and Conditions apply exclusively to the use of the website www.roviniete.ro, operated by SCALA ASSISTANCE S.R.L., as owner and administrator of the platform.

The language of communication between the parties is Romanian.

All information published on the website, including fees, offers and automatic messages, is available in Romanian and may be updated periodically without prior notice.

SCALA ASSISTANCE S.R.L. declares that the products and services available on the www.roviniete.ro platform are distributed in accordance with applicable legislation and valid official authorizations.

By accessing and using the website, the User confirms that they have read, understood and fully accepted these General Terms and Conditions of Use.

If any provisions of this document become null or unenforceable, the remaining clauses shall remain fully valid.

If any provision of these Terms and Conditions is considered void, unlawful or unenforceable, this shall not affect the validity of the other provisions, which shall continue to produce effects.

SPECIAL TERMS AND CONDITIONS – FINE PAYMENT SERVICE UNDER NBR AUTHORIZATION NO. IP-RO-0006-A-RO-034

1. APPLICABILITY AND COMPLEMENTARY NATURE

These special conditions apply exclusively to the fine payment service provided through the digital platform www.roviniete.ro, operated by SCALA ASSISTANCE S.R.L., as agent of the payment institution SMITH & SMITH S.R.L.

SMITH & SMITH S.R.L. is a payment institution authorized by the National Bank of Romania, registered in the Register of Payment Institutions under number IP-RO-0006-A-RO-034.

The service allows Users to pay contravention fines and other charges issued by public authorities in Romania electronically, in a secure and traceable manner, through a fully digital flow. These special conditions complement the General Terms and Conditions of Use of the www.roviniete.ro platform and shall be interpreted together with them.

In the event of any discrepancy between these special conditions and the General Terms and Conditions, the provisions of this chapter shall prevail exclusively for the “Fine Payment” service, without affecting the applicability of the other provisions.
 

2. DESCRIPTION OF THE SERVICE

Users of the www.roviniete.ro platform may make online payments for contravention fines or other charges issued by authorities in Romania via a secure digital flow developed by SCALA ASSISTANCE S.R.L. as agent of the authorized payment institution SMITH & SMITH S.R.L.

Payment procedure:

  • the User enters the data required to identify the payment document (for example: series and number of the contravention report, personal identification number – CNP – of the sanctioned person, amount of the fine or charge and the name of the issuing authority);
  • the payment is processed online through an authorized payment processor (e.g. PayU);
  • the funds are automatically transferred from the payer, via SMITH & SMITH S.R.L., to the competent territorial administrative unit (UAT) of the contravening person’s domicile.

After the payment, the User will receive an electronic confirmation of the transaction. This does not guarantee immediate recording of the fine as settled in the system of the competent authority, as processing depends exclusively on the deadlines and internal procedures of the beneficiary public institution.

The service is available 24/7 for initiating payment; however, the effective processing of the transaction takes place within up to 5 working days, through the agent Smith & Smith S.R.L., registered with the NBR under no. IP-RO-0006-A-RO-034.

After the payment is processed, the User is responsible for checking the electronic confirmation and, where appropriate, monitoring the update of the fine status in the records of the competent authority.
 

3. PARTIES INVOLVED

The following entities are involved in providing the fine payment service via the www.roviniete.ro platform:

  • SCALA ASSISTANCE S.R.L., having its registered office in Romania, Cluj-Napoca Municipality, Str. Fabricii de Chibrituri no. 13-21, ICPIAF Center Office Building, 1st floor, Cluj County, as authorized agent of SMITH & SMITH S.R.L. and technical operator of the platform and provider of the digital infrastructure. SCALA ASSISTANCE S.R.L. manages the website www.roviniete.ro and ensures the proper functioning of the payment flow, without collecting or retaining funds in its own name. SCALA ASSISTANCE S.R.L. acts exclusively as a technical and commercial interface between the User and the authorized payment institution, without holding or processing funds in its own name.
  • SMITH & SMITH S.R.L., a payment institution authorized by the National Bank of Romania (NBR), as payment operator, responsible for receiving funds from the User and transmitting them to the beneficiary public authority.
  • The User – natural or legal person using the service for the purpose of paying a fine or charge and who, by accessing the payment functionality, fully accepts these special conditions and the General Terms and Conditions of Use of the platform.

All entities involved in the payment process comply with the legal requirements regarding data confidentiality and transaction security, according to applicable Romanian and European legislation.
 

4. ACCEPTANCE OF CONDITIONS

By accessing and using the payment service available on www.roviniete.ro, the User expresses their express, full and unconditional agreement with these special conditions and with the General Terms and Conditions of the platform.

In the absence of acceptance of these conditions, the User may not access or use the “Fine Payment” functionality available on the website.

Specifically, the User declares that:

  • they have read and understood this document;
  • they are at least 18 years old and have full legal capacity, in accordance with Romanian law;
  • they agree to the irreversible and customized nature of the payment operation;
  • they accept the processing of personal data for the purposes mentioned in the Privacy Policy and in the dedicated personal data protection section.

Acceptance of the Terms and Conditions is carried out by ticking the “I accept the terms and conditions” checkbox before finalizing the payment. This action constitutes valid consent and is equivalent to concluding a distance contract, in accordance with Law no. 365/2002 on electronic commerce and Law no. 214/2024 on the use of the electronic signature, time stamp and the provision of trust services based thereon.

By making the payment, the User acknowledges the irreversible nature of the transaction and confirms that they have checked the accuracy of all data entered.
 

5. FEES, COMMISSIONS AND COST TRANSPARENCY

5.1. Cost elements

Use of the payment service involves payment by the User of the following cost elements:

  • the full amount established by the issuing public authority – an amount which is not subject to VAT;
  • the processing commission charged by the payment institution SMITH & SMITH S.R.L., for facilitating and settling the transaction.

5.2. Commission coverage and display

The processing commission covers all costs related to payment processing, maintenance of the digital infrastructure, technical intermediation and information and support services provided to Users of the www.roviniete.ro platform.

All fees and commissions related to the service are clearly displayed on the payment page before finalizing the transaction. No additional charges will be applied after the payment confirmation.

5.3. Commission changes

SCALA ASSISTANCE S.R.L. and SMITH & SMITH S.R.L. may change the value of the commissions charged, in compliance with the legislation on prior information of the User. Any change will apply only to transactions initiated after the publication of the new values on the website.

The amounts corresponding to fines are values set by public authorities and cannot be modified or split by the Provider or the payment agent.
 

6. CONFIRMATION AND RESPONSIBILITIES

6.1. Confirmation

After making the payment, the User automatically receives by e-mail an electronic confirmation attesting that the transaction has been processed by the www.roviniete.ro platform and sent for settlement to the competent territorial administrative unit (UAT). The confirmation message is proof of payment made via the platform, but does not constitute proof of settlement of the obligation towards the public authority.

6.2. Settlement of the fine

The payment confirmation does not equate to the automatic settlement of the fine, as the entry in the authority’s system is carried out according to its own administrative procedures and deadlines.

6.3. User responsibilities

The User is fully responsible for:

  • entering correctly all data requested in the payment form;
  • checking the information before finalizing the order;
  • keeping the electronic payment confirmation until the fine is officially recorded in the public authority’s system.

6.4. Limitation of liability of SCALA ASSISTANCE S.R.L. and SMITH & SMITH S.R.L.

SCALA ASSISTANCE S.R.L. and SMITH & SMITH S.R.L. accept no liability for failure to register the payment where this is caused by:

  • incorrect data provided by the User;
  • deficiencies in the digital infrastructure of the public institution;
  • delays caused by third-party payment processors (e.g. PayU);
  • force majeure situations or malfunctions external to the platform.

The Provider and the payment agent cannot be held liable for failure to record the fine in the public authority’s system if the payment has been electronically confirmed and correctly processed via the platform.
 

7. REFUNDS AND CANCELLATIONS

7.1. Exemption from the right of withdrawal

In accordance with Article 16(c) of Government Emergency Ordinance no. 34/2014 on consumer rights, the fine payment service provided via the www.roviniete.ro platform is exempt from the right of withdrawal provided by OUG no. 34/2014, as it involves the provision of clearly personalized services carried out on the basis of unique parameters provided by the User. The User is expressly informed, before finalizing the payment, that by confirming the transaction they lose their right of withdrawal.

7.2. Irreversibility

After payment confirmation, the service becomes irreversible and the transaction can no longer be cancelled, as the funds are automatically transferred to the beneficiary public institution. Any errors in the data entered by the User (for example: CNP, report number, amount or issuing authority) cannot be corrected later and are not subject to refunds.

7.3. Exceptional refunds

Refund of amounts may be requested only in exceptional cases, such as the objective impossibility of transmitting funds to the beneficiary public institution for reasons beyond the User’s control.

7.4. Refunds via the public institution

In all other situations, the refund of amounts paid may be requested only directly from the beneficiary public institution of the payment, in accordance with its own procedures.

7.5. Refunds by SCALA ASSISTANCE S.R.L. and SMITH & SMITH S.R.L.

SCALA ASSISTANCE S.R.L. and SMITH & SMITH S.R.L. cannot make direct refunds to the User, as they do not manage the collected funds in their own name, except in exceptional situations.
 

8. PERSONAL DATA PROTECTION

8.1. Legal framework and roles

Users’ personal data is processed by SCALA ASSISTANCE S.R.L. and SMITH & SMITH S.R.L., as joint controllers, in accordance with applicable legal provisions in the field of data protection and payment services:

  • Regulation (EU) 2016/679 (GDPR) on the protection of individuals with regard to the processing of personal data;
  • Law no. 190/2018 on measures for the implementation of Regulation (EU) 2016/679;
  • specific legislation applicable to payment institutions.

The two entities jointly determine the purposes and means of data processing in the context of the fine payment service, each being obliged to ensure data protection within its area of responsibility.

8.2. Purposes of processing

The purposes of data collection and processing are:

  • provision of the payment processing service;
  • correct identification of the payment and the User;
  • performance of legal and contractual obligations regarding payment services;
  • prevention of money laundering and fraud;
  • ensuring transaction traceability and operational audit;
  • fulfillment of reporting obligations to competent authorities under legislation on payment services and anti-money laundering.

8.3. Processed data and storage

Data collected may include: payer’s first and last name, personal identification number (CNP)/tax ID (CUI), e-mail address, telephone number, payment information (e.g. IBAN, amount, transaction date), fine identification codes, IP address and other technical data necessary for transaction security and traceability.

Data is kept for the period necessary to achieve the above-mentioned purposes, in accordance with the legal deadlines applicable to financial and fiscal services. Data is stored on secure servers located within the European Union, and access is restricted exclusively to authorized personnel.

8.4. Users’ rights

Users benefit from all rights provided by Regulation (EU) 2016/679, including the right of access, rectification, erasure (“right to be forgotten”), restriction of processing, objection, data portability and the right to lodge a complaint with ANSPDCP.

SCALA ASSISTANCE S.R.L. responds to requests submitted by Users as soon as possible, but no later than 30 calendar days from their receipt, in accordance with applicable legislation.

For situations not resolved amicably, Users may use the alternative dispute resolution (ADR) procedures available through the National Authority for Consumer Protection – https://reclamatiisal.anpc.ro/Depune-cerere-SAL.
 

10. JURISDICTION AND APPLICABLE REGULATIONS

10.1. Applicable law

These special conditions and the fine payment service available on the www.roviniete.ro platform are governed by Romanian law in force, including:

  • Law no. 365/2002 on electronic commerce, republished;
  • Law no. 214/2024 on the use of the electronic signature, time stamp and the provision of trust services based thereon;
  • Law no. 209/2019 on payment services and amending certain legislative acts;
  • Government Emergency Ordinance no. 34/2014 on consumer rights, as subsequently amended and supplemented;
  • Regulation (EU) 2016/679 (GDPR) on personal data protection;
  • Law no. 190/2018 on measures for the implementation of Regulation (EU) 2016/679.

For aspects not expressly provided for in these conditions, the provisions of national and European legislation on payment services and consumer protection shall apply.

10.2. Dispute resolution

Any disagreements or disputes between the User and SCALA ASSISTANCE S.R.L. and/or SMITH & SMITH S.R.L. shall be resolved primarily amicably, by contacting the support team at comenzi@roviniete.ro.

If an amicable settlement is not possible, disputes shall be referred to the competent courts in Romania, at the registered office of SCALA ASSISTANCE S.R.L. Users who are natural persons may also use the alternative dispute resolution (ADR) procedures provided by the National Authority for Consumer Protection (ANPC), via the Integrated ADR Electronic Platform – https://reclamatiisal.anpc.ro/Depune-cerere-SAL.
